County Employee Files Sexual Harassment Suit

A lawsuit was just filed against the Bernalillo County Clerk’s Office under former Clerk, Mary Herrera, who is now the secretary of state.

The suit, filed by a previous employee, claims he was sexually harassed by a male supervisor while working.

Allegations of Harassment

Richard Espinoza, who worked as a Bureau of Elections Technician and is also the vice president of the county’s white-collar union and a basketball coach at the local high school, filed the suit in June in the U.S. District Court in Albuquerque.

Espinoza claims that when Jeff Carbajal began working at the office in 2004, he began to be sexually harassed by the spokesman for the Secretary of State’s Office.

Carbajal allegedly asked Espinoza to have sexual relations with him and made several sexual advances towards him throughout the workday.

The lawsuit also reports that other county employees spread false rumors saying that Espinoza had bragged to them about having sex with his male cousin.

Placed on Leave

Besides being sexually harassed, Espinoza claims that he was placed on administrative leave after filing a complaint against Carbajal.

Reports state that another employee told Espinoza that he was being put on leave due to the fact that Carbajal was more important as election time drew near.

“It’s been really hard to deal with,” says Espinoza, “I’ve been stressed out. I’ve been having anxiety.”

Defendant’s Questionable Background

This isn’t the first time Carbajal has faced legal troubles.

In the past, he has been accused of pocketing money made by local liquor establishments.

In January of 2004, he pleaded guilty to embezzlement charges.

Espinoza seeks monetary damages.
