Lawsuit over Deadly Bike Crash Forthcoming

The attorney of two men who were involved in a deadly bicycle accident will sue several agencies for more than $25 million.

According to the lawsuit, the city of Richmond, and Caltrans created dangerous conditions near a freeway bicycle lane by neglecting to post signs to warn bicyclists and motorists that there was no dividing barrier between automobile traffic and bicyclists.

The lawsuit, filed by the men’s wives and daughters, names as defendants Caltrans, the city, and three other agencies. The attorney representing them, Christopher Dolan, expects the suit will be filed in the State Superior court within two months.

“Caltrans has 45 days to respond to the complaint,” said Dolan. “But we anticipate they will go into denial mode and not face up to the fact that they created an idiotic death trap.”

The Accident

Dan Doellstedt, 40, and Dan Weinstein, 42, were riding their bikes in a bicycle lane that goes directly onto the freeway. Once on the freeway, Fayez Algiheny, 55, swerved into a wall, then went all the way across the road and through the 10-foot-wide bicycle lane, hitting both cyclists, according to the Highway Patrol’s accident report.

Weinstein died from massive head trauma, and Doellstedt suffered a spine injury and became paralyzed from the waist down.

Algiheny claimed she swerved to avoid what mat she thought was a brown BMW that cut her off, but witnesses told investigators that they did not see any cars near Elgiheny’s at the time of the accident.

The bike path has remained open since the accident, but Caltrans installed signs for both cyclists and drivers. They also installed Botts’ dots, which are raised dots on the road that warn drivers they are driving out of their lane.

“It’s too bad a man had to die and another had to be made a paraplegic before Caltrans did what it should have done years ago,” said Dolan. “It’s a good thing for others, but it’s too little, too late for my clients.”
