Lawsuit Filed After Fatal Motorcycle Accident

The son of a woman killed in a motorcycle accident late last year has filed a wrongful death lawsuit seeking $1.5 million in damages.

Mary Ellen Gallagher and her husband, Robert, were hit by a car on September 15, 2005, while riding on their Harley Davidson motorcycle. The impact threw them both off the bike and into the road.

Five days later, Mary Ellen, 45, died of injuries sustained during the accident. Her husband remains paralyzed.

Gerald O’Rourke, Gallagher’s son, filed the lawsuit against Ronald Thompson, who was the driver of the vehicle that struck the motorcycle.

According to the lawsuit, O’Rourke “has suffered and will continue to suffer mental anguish, emotional pain and suffering, loss of society, companionship, comfort, protection, and care.”

The lawsuit is seeking damages to cover medical and funeral expenses as well as pain and suffering.
