Rochester Settles Disparagement Suit with Premier

Rochester Medical Corp. said it settled the disparagement lawsuit it filed against Premier Inc. and Premier Purchasing Partners LP for nearly $9 million.

Rochester claims that Premier, and several other companies made disparaging comments that damaged its reputation and image.

The suit accused C.R. Bard, Inc., Tyco International Inc., Tyco Healthcare Group LP, Novation LLC, VHA Inc., Premier, and Premier Purchasing of anti-competitive practices and product disparagement.

Rochester claimed these companies made the disparaging comments in an effort to defame Rochester and keep it from entering into the urological product and hospital markets.

Rochester said that per the settlement, Premier will pay $8.8 million and will be dismissed from the lawsuit.
This settlement will not affect the rest of the lawsuit. Rochester’s suit against C.R. Bard, Inc., Tyco Healthcare Group L.P., Tyco International Inc., VHA Inc., and Novation LLC still remains and is scheduled to go to trial in May 2007.
