Texas Woman Files Defective Product Lawsuit

A woman living in Marshall, Texas recently filed a personal injury lawsuit against Johnson & Johnson and Ortho-McNeil Pharmaceutical Research and Development Inc., claiming her blood clot injuries were a result of the defective product, Ortho Evra.  

What is Ortho Evra?

Ortho Evra is a form of birth control in which hormones are released through a patch directly into the skin. The Ortho Evra patch hit the market in 2002 and was well received by women seeking a more convenient way to take the Pill. The patch is applied once a week, three weeks out of the month. 

Texas Ortho Evra Lawsuit

Karentha Easterwood, 36, filed a personal injury lawsuit Dec. 1 in the Marshall Division of the Eastern District of Texas, claiming she suffered serious injuries after using the defective birth control patch. According to the lawsuit, Easterwood suffered the following injuries while using the birth control: 

  • Pulmonary embolism
  • Blood clots in her lungs 

Ortho Eva Side Effects

According to the lawsuit, the defendant companies are at fault because they failed to properly warn users of the dangerous risks associated with using Ortho Evra. The lawsuit states that the label lists the most common side effects of the birth control patch, including: 

  • Nausea
  • Vomiting
  • Breast symptoms
  • Headache
  • Application site reaction 

However, according to the lawsuit, the manufacturer failed to include the potential risks of the following life-threatening conditions: 

  • Deep vein thrombosis
  • Pulmonary embolism
  • Stroke death 

Injured Woman Seeks Compensation

Easterwood claims the defendant failed to warn users of the heightened risk of serious conditions, and therefore mislead her and thousands of other users. She is seeking sums in excess of $75,000 for losses including:

  • Medical costs
  • Permanent physical injury
  • Emotional pain and suffering
  • Physical limitations
  • Emotional distress
  • Loss of future earnings
