Personal Injury Suit Filed Against Mother and Son

A Waco, Texas mother and son were named defendants in a personal injury lawsuit Oct. 4. According to the suit, Margaret Mills and her son, Richard Coke Mills III, are responsible for injuries sustained to Matthew and Nicole Short’s child in an auto accident that occurred in April.  

The defense attorney, Rick Bostwick, referred to the personal injury lawsuit filed against his clients as a “friendly suit,” which according to him, has to be filed when a minor is involved.  

The extent of the injuries sustained by the plaintiff’s daughter were not named.  

Defendant Suspected of Drunk Driving 

According to reports, Richard Mills, who was driving his mother’s car when the accident occurred, was arrested at the scene for suspicion of drunk driving. The DUI charges are still pending. Richard was reportedly arrested under the suspicion of driving under the influence in October 2006, but the charges were never pursued. 

Penalties for Texas DUI Convictions 

Because every drunken driving case is different, there are several factors that determine the punishment. If he is found guilty, this would be Richard’s first DUI offense, meaning, he faces the following penalties: 

  • Anywhere from 72 hours to six days in jail
  • Up to $2,000 in fines
  • $1,000-$2,000/ year surcharge for three years
  • License suspension for one year
  • Mandatory DUI classes 

If convicted, Richard also faces the financial burden of possible lost wages and lost future career or education opportunities.  

Mother Faces Criminal Charges in another Suit 

According to reports, Margaret Mills, 67, is involved in another trial simultaneously. She reportedly plead guilty to third-degree felony theft charges during her employment with Downtown Waco Inc. Her trial is currently underway.
